A Highest Use Commercial Methodology

FOX Strategy™

Financial Outcome Maximized

Sell for more than a single number. Turn equity into an outcome designed around what matters to you. After a property's highest-use opportunities have been considered, FOX Strategy helps an owner explore how the financial structure of a sale may affect the overall result.

Conventional Sale

List. Accept an offer. Close. Walk away.

Most property owners are shown essentially one path. The property is listed, a buyer makes an offer, the parties close, and the owner receives the net proceeds.

That path is direct, familiar, and may be exactly right. FOX Strategy does not reject the conventional sale. It asks whether the owner should compare it with other reasonable structures before deciding.

The Question

What financial outcome are you actually trying to create?

Headline price matters, but it is not the only term that shapes an owner's result. The right discussion begins with the owner's priorities and the tradeoffs they are prepared to accept.

  • Cash at closing
  • Total sale consideration
  • Timing
  • Potential recurring income
  • Financing terms
  • Risk
  • Liquidity
  • Buyer quality
  • The owner's future plans

FOX Strategy

Property opportunity first. Structure second.

Highest Use Commercial first works to understand what the property could become and who may value that opportunity. FOX Strategy follows that work by exploring how a potential transaction might be structured around the owner's objectives. It is a brokerage planning process, not a promise that a particular structure or result will be available.

  1. 01

    Understand the property

Begin with the asset, its present use, its plausible next use, and the buyer audience that may value that opportunity.

  2. 02

    Understand the owner

Clarify the owner's priorities for cash, timing, income, liquidity, risk, and what comes after the sale.

  3. 03

    Explore reasonable structures

Consider whether a conventional sale or another legitimate structure deserves further analysis by the owner's professional advisers.

  4. 04

    Compare the whole outcome

Evaluate the tradeoffs in price, terms, timing, security, flexibility, and risk before choosing how to approach the market.

Illustrative Structures

Alternatives to compare, not outcomes to promise.

The structures below are educational examples. Availability, suitability, terms, buyer interest, financing, tax treatment, and financial results depend on the facts of a specific transaction.

Conventional sale

A buyer pays the agreed consideration at closing, commonly with cash and third-party financing. This familiar path may be exactly right for the owner.

Seller financing

An owner may agree to receive part of the consideration over time under negotiated terms. Credit quality, collateral, documents, default remedies, liquidity, and tax treatment require careful professional review.

Timing and closing terms

A transaction may be structured around due diligence, financing, possession, lease matters, or other milestones when those terms serve both parties and remain commercially workable.

Other negotiated structures

Depending on the facts, qualified legal, tax, lending, and financial advisers may identify other lawful alternatives worth comparing. Highest Use Commercial does not provide those professional opinions.

Financial Outcome Maximized

Compare the whole transaction before choosing the path.

The objective is not simply to pursue the highest headline price. It is to compare reasonable alternatives across the terms that matter to the owner, then decide whether the conventional structure remains the best fit.

“Maximized” describes the discipline of considering the owner's complete objective. It does not guarantee that a different structure, higher price, recurring income, specific buyer, tax result, closing, or financial outcome will be available.

Professional-Adviser Coordination

The right disciplines at the table.

Highest Use Commercial provides licensed real estate brokerage and transaction representation. We do not provide legal, tax, accounting, securities, lending, architectural, engineering, entitlement, environmental, or governmental advice.

Owners should consult their own attorney, CPA, lender, financial adviser, and other qualified professionals before selecting, documenting, or relying on any transaction structure. Any potential principal or investor participation by Ross or an affiliated entity would require separate disclosure, review, and written documentation.

Website use and a complimentary review do not create a brokerage, agency, fiduciary, or advisory relationship. A brokerage relationship begins only through a separate signed written agreement.

Begin With the Property

First understand what the property could become.

The complimentary Highest-Use Review is the first step. If the property and your objectives warrant a closer look at transaction structure, FOX Strategy follows naturally within the same Highest Use Commercial relationship.
